Welcome to Party Decoration NYC. These Terms of Service (“Terms”) govern your use of our website located at partydecornyc.com (the “Site”) and your engagement with our event decoration and planning services (“Services”). Please read these Terms carefully. By accessing our Site or booking our Services, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our Site or Services.

Party Decoration NYC (“we,” “us,” or “our”) reserves the right to update or modify these Terms at any time without prior notice. Your continued use of the Site or Services after any changes indicates your acceptance of the new Terms.

1. Services Provided

Party Decoration NYC provides professional event decoration services, including but not limited to custom balloon decorations, wedding decor, holiday and seasonal decor, and full event planning support. The specific details, scope, and deliverables for each project will be outlined in a separate, custom proposal and/or contract provided to the Client.

2. Booking & Payment Policy

Quotes & Estimates: All quotes provided are estimates based on the information given by the Client. Quotes are valid for [Insert Number, e.g., 14] days from the date of issue. Final pricing is confirmed only upon the signing of a service agreement.
Deposit: To secure your event date, a non-refundable deposit of [Insert Percentage, e.g., 50%] of the total quoted price is required. No date is reserved until the deposit has been received and the service agreement has been signed.
Final Payment: The remaining balance is due [Insert Number, e.g., 7 or 14] days prior to the event date. For bookings made less than [Insert Number] days before the event, full payment is required at the time of booking.

Minimum Order: Please note that our balloon decoration services have a minimum order requirement of $400.

3. Cancellations & Refunds

Client Cancellation: All cancellations must be submitted in writing via email to [email protected].
Cancellations made more than [Insert Number, e.g., 30] days prior to the event date will not receive a refund of the non-refundable deposit, but no further payment will be due.
Cancellations made within [Insert Number, e.g., 30] days of the event date are responsible for the full remaining balance.
Rescheduling: We understand that plans can change. We will make a reasonable effort to accommodate one (1) rescheduling request, subject to our availability. If we cannot accommodate the new date, the standard cancellation policy applies.
Force Majeure: Party Decoration NYC is not liable for failure to perform its obligations if such failure is as a result of Acts of God (including fire, flood, earthquake, storm, hurricane, or other natural disaster), war, invasion, act of foreign enemies, hostilities (regardless of whether war is declared), civil war, rebellion, revolution, insurrection, military or usurped power or confiscation, terrorist activities, nationalization, government sanction, blockage, embargo, labor dispute, strike, lockout, or interruption or failure of electricity or telephone service. In such an event, we will work with the Client to find a suitable resolution, which may include rescheduling or issuing a partial credit for future services, at our sole discretion.

4. Client Responsibilities

Access to Venue: The Client is responsible for ensuring that Party Decoration NYC has access to the event venue at the agreed-upon setup time. Any delays caused by lack of access may result in additional fees or an incomplete setup.
Venue Permissions: It is the Client’s sole responsibility to confirm with the venue that all planned decorations (e.g., hanging items from ceilings/walls, use of command hooks, etc.) are permitted. Party Decoration NYC is not responsible for any fines or issues arising from venue restrictions.
Furniture: Party Decoration NYC does not provide furniture (tables, chairs, sofas, etc.). We will style and decorate the furniture provided by the Client or the venue.
Environment: For balloon decorations, the Client acknowledges that balloons are sensitive to temperature, direct sunlight, and sharp objects. We are not responsible for popped or deflated balloons once our team has completed the installation and left the premises.

5. Liability & Ownership

Limitation of Liability: To the fullest extent permitted by law, Party Decoration NYC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from (a) your use of our Services; (b) any conduct or content of any third party; or (c) unauthorized access, use, or alteration of your content. In no event shall our aggregate liability for all claims exceed the total amount paid by the Client to Party Decoration NYC for the specific event in question.
Rentals: Items designated as “Rentals” (e.g., certain vases, stands, backdrops, Christmas decor storage boxes) remain the property of Party Decoration NYC and must be returned in the same condition as they were provided. The Client is responsible for the replacement cost of any lost, stolen, or damaged rental items.
Media Release: Party Decoration NYC reserves the right to take photographs and videos of our work at your event and use them for marketing, advertising, and portfolio purposes (including on our website and social media). We will make every effort not to include identifiable guests without permission, but the decor itself may be featured. If you do not wish for photos of your event to be used, you must notify us in writing prior to the event.

6. Website Use

Intellectual Property: All content on this Site, including text, graphics, logos, images, and software, is the property of Party Decoration NYC or its content suppliers and is protected by United States and international copyright laws.
Prohibited Use: You agree not to use the Site for any unlawful purpose or in any way that could damage, disable, overburden, or impair the Site.

7. Governing Law

These Terms shall be governed and construed in accordance with the laws of the State of New York, without regard to its conflict of law provisions. You agree to submit to the personal jurisdiction of the state and federal courts located in New York City, New York, for any actions for which we retain the right to seek injunctive or other equitable relief.
